1. Agreement and eligibility
These Terms of Service ("Terms") are an agreement between you and Ogbodo Law Firm PLLC ("Ogbodo Law," "we," "us," or "our"), the operator of GavelMind. By creating an account, purchasing a subscription, or using GavelMind, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and legally capable of entering this agreement. If you use GavelMind for an organization, you represent that you have authority to bind that organization.
2. What GavelMind provides
GavelMind is an AI-assisted educational service for courtroom training. Features may include simulated cases, role-based courtroom participants, voice interaction, case creation, uploaded materials, transcripts, session summaries, progress history, and paid features.
We may add, change, pause, or remove features. We will use reasonable care when a material change affects an active paid subscription and will honor rights that applicable law does not allow us to waive.
3. Education only; AI limitations
AI-generated dialogue, case material, scores, summaries, and other output may be inaccurate, incomplete, outdated, fabricated, or biased. Simulations do not predict an actual judge, jury, witness, opposing counsel, court, or legal outcome. You are responsible for independent professional judgment and must not rely on GavelMind in an actual proceeding or as a substitute for qualified counsel.
4. Your account
You must provide accurate information, keep credentials secure, and notify us of suspected unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. You may not share, sell, or transfer an account without permission.
You may request account deletion through the app or our public deletion route. Deleting a GavelMind account does not automatically cancel a subscription billed by Apple or Google.
5. Your content and confidentiality
You retain ownership of content you submit. You grant us a limited, worldwide license to host, copy, transmit, process, and create technical or AI-generated outputs from that content only as needed to operate, secure, support, and improve GavelMind, subject to the Privacy Policy.
You must have the rights, permissions, and lawful basis needed for anything you submit. Do not upload or speak privileged, client-confidential, classified, infringing, unlawful, or real-case personal information unless you are authorized and have determined that GavelMind is appropriate for that use. GavelMind is not a legal records system or confidential client repository.
Feedback you voluntarily send about the product may be used to improve GavelMind without an obligation to compensate you, but it will not give us ownership of your case or training content.
6. Free access, trials, subscriptions, and refunds
GavelMind may offer limited free access, introductory trials, and paid monthly or annual plans. The price, currency, billing period, trial eligibility, and included features shown at checkout control. Plans and availability may differ by platform or country.
Subscriptions may renew automatically unless canceled before renewal through the platform where you purchased them. Apple App Store and Google Play subscriptions must be managed in the applicable store account. Deleting GavelMind or deleting your GavelMind account does not itself cancel store billing.
Refunds are handled under the rules of the payment platform and mandatory consumer law. Nothing in these Terms limits statutory cancellation, refund, or other consumer rights that cannot lawfully be waived.
7. Acceptable use
You may not:
- Use GavelMind for unlawful, fraudulent, harassing, discriminatory, or harmful activity.
- Submit content you lack rights or authority to process.
- Attempt unauthorized access, evade security or usage limits, introduce malware, or interfere with the service.
- Reverse engineer the service except where applicable law expressly permits it.
- Extract system instructions, probe models or infrastructure for abuse, or automate access in a way that burdens the service.
- Misrepresent AI output as verified law, professional advice, or a real court record.
- Use GavelMind to provide automated legal advice to third parties without independent qualified review.
8. GavelMind intellectual property
GavelMind, its software, brand, interface, and operator-provided content are owned by us or our licensors and protected by applicable law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended training purpose.
9. Suspension and termination
You may stop using GavelMind at any time. We may suspend or terminate access when reasonably necessary to address a material breach, security risk, fraud, illegal activity, non-payment, or harm to other users or the service. Where appropriate, we will provide notice and an opportunity to resolve the issue.
10. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAVELMIND IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR AI OUTPUT WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OGBODO LAW AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, OR RELIANCE ON AI OUTPUT. OUR AGGREGATE LIABILITY ARISING FROM GAVELMIND WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID FOR GAVELMIND IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These exclusions do not apply to liability that cannot be excluded or limited under applicable law, including certain consumer, data-protection, gross-negligence, intentional-misconduct, personal-injury, or statutory rights.
11. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to rights that applicable law does not allow you to waive, disputes will be brought in the state or federal courts serving Harris County, Texas. If you are a consumer outside the United States, you retain mandatory protections and access to courts provided by the law of your habitual residence.
12. Changes and general terms
We may update these Terms. We will publish the revised date and provide additional notice when required for a material change. If part of these Terms is unenforceable, the remaining terms remain effective. A failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the service, subject to applicable law.
